Each party agrees that the electronic signatures, whether digital or encrypted, of the parties included in this agreement are intended to authenticate this writing and to have the same force and effect as manual signatures. Electronic Signature means any electronic sound, symbol, or process attached to or logically associated with a record and executed and adopted by a party with the intent to sign such record, including facsimile or email electronic signatures pursuant to the Massachusetts Uniform Electronic Transactions Act (M.G.L. c. 110G, § 1 et seq.) as amended from time to time.

In consideration for being allowed to participate in this program, on behalf of myself and my next of kin, heirs and representatives, and to the maximum extent permitted by law, I hereby release and waive any claim against, and agree not to sue Barcelona SAE, and their employees, officers or agents, regarding any and all claims and causes of action for damage to or loss of property, personal illness or injury, or death, arising out of any travel, program or activity conducted by or associated with Barcelona SAE or any institution serving as sponsor of the Barcelona SAE-administered academic program unless the injury or loss, accident or damage, delay deviation or curtailment is solely caused by Barcelona SAE's gross negligence.

*Participant is defined as a student, or for customized programs, this could include faculty and staff of the participant institution, parents, siblings, dependents, guests, and others attending the program.

I understand that I am voluntarily participating in this program and, to the best of my knowledge, I am able to fully participate in this program. If I am participating in a non-virtual program, I understand that I will be going to a destination, with different customs, standards, laws and risks than those to which I am accustomed. I am aware of the risks associated with traveling to/from and participating in this program, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. I understand that these injuries or outcomes may arise from my own or other’s actions, inaction, or negligence; conditions related to travel; or the condition of the program location(s). I understand that I may be arrested or imprisoned if I do not conform to local laws, that there is crime in other countries and that I may be a victim of a crime, and that there may be local customs and standards to which I am not accustomed. I voluntarily accept those risks and will not hold Barcelona SAE or its sponsoring institutions responsible for any of these occurrences or conditions. Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this program, including travel to, from and during the program.

I agree that I am not relying on any representations or warranties made by Barcelona SAE regarding safety, customs, perils or other risks associated with travel to a foreign country and I have made my own independent assessment of such safety, customs or other risks as I have deemed appropriate.

I understand that Barcelona SAE or the sponsoring academic institution may cancel or alter any program or course for insufficient enrollment, safety or otherwise, and may make changes or substitutions with respect to the program. Barcelona SAE reserves the right to increase fees should any unforeseen circumstances make these actions advisable or necessary.

I understand that Barcelona SAE will not be responsible for any medical costs associated with any injury or illness I may sustain during my program. I also understand that it is my responsibility to determine whether or not the medical and accident insurance included in the program is adequate for my personal circumstances, and, if not, to obtain any other insurance needed to supplement the provided insurance package.

I agree to hold Barcelona SAE harmless from any and all claims including any legal costs, attorney's fees, fines or other expenses associated with any legal proceeding I may be involved in as a result of my participation in this Program, including travel to, from and during the program, whether they are civil or criminal in nature. I also understand that Barcelona SAE is not responsible for obtaining or locating legal counsel for me and I will have to make any such arrangements myself. If Barcelona SAE incurs any of these types of expenses, I agree to reimburse Barcelona SAE.

I will comply with Barcelona SAE and the sponsoring institution's rules with any housing, academic partner institution, or host internship site rules, standards and instructions for participant behavior. I understand that failure to do so may result in my expulsion from the program. I fully understand that I am solely responsible for any and all costs arising out of my voluntary or involuntary withdrawal from my program.

I understand that Barcelona SAE occasionally uses statements by its students and/or their photographs, and I consent to such use of my comments and photographic likeness. I further agree that Barcelona SAE may release my name and email address to other program participants and to future applicants of Barcelona SAE programs. I authorize Barcelona SAE to release personal contact details and other references to the host institution (if applicable), their personnel, and Barcelona SAE staff.

I understand and allow Barcelona SAE, the host university, my home university, internship placement site staff, local staff, and emergency services to share, manage, and obtain information about my location, condition and other pertinent facts about me in the event of an issue or emergency. Barcelona SAE may contact my home university to update them on any situation that occurs while I am on a Barcelona SAE program.

I agree to conduct myself in a professional and respectful manner while abroad, as a representative of my home university, Barcelona SAE, and country. This means being on time to classes, internships, or Barcelona SAE events and informing the proper person if I will miss or be late to any scheduled class, work day or event. I agree to inform Barcelona SAE staff of issues with housing, courses, internships, or any health and safety related situation as quickly as possible. If I am attending an internship program, I agree to communicate any problems I am having at the internship to my supervisor and disclose these problems to the Barcelona SAE onsite staff. I understand that Barcelona SAE cannot help with or fix a problem if they do not know about it and agree to work in partnership with Barcelona SAE.

I certify that I have read in full this Agreement and Release as well as all literature presented to me by Barcelona SAE and agree to comply with all of the terms and conditions stated therein. This includes the Code of Conduct and all Pre-Departure Materials. This agreement will be effective upon my signature (and the signature of my parent/guardian if I am under the age of 18) and shall be governed by the laws of the Commonwealth of Massachusetts. If this Agreement and Release is signed by a parent or guardian, such parent or guardian agrees to indemnify and hold harmless Barcelona SAE against and from any claim which may be brought by the child or ward of such parent or guardian on account of his or her participation in any Barcelona SAE-administered program, if such individual brings any legal proceeding against Barcelona SAE. This indemnity shall include Barcelona SAE's attorney's fees and costs of defense.

PHOTO RELEASE

Please select one of the options below in regards to the photo release. Opting out means that Barcelona SAE will be unable to publish any program photos of you for marketing purposes, which includes social media, university advisor newsletters, or our website, among other things. The responsibility will be on you to remind any staff at our activities or excursions that you do not want to appear in any photos, and to remove yourself from any group photos being taken.
